Digital Omnibus: The Data Act must not be weakened!

On 19 November, the European Commission presented its proposal for simplifications in the digital sector. On this, ZDH Secretary General Holger Schwannecke comments:

"We support simplifications in digital regulations. However, important legal frameworks for fair competition in the economy, such as the Data Act, must not be watered down or undermined. Fair access to data is essential for craft businesses. In this regard, the accompanying Data Union Strategy should be viewed critically. 

Nevertheless, the actual simplification measures in the AI omnibus package can provide craft businesses with greater legal certainty: data should only be considered personal and therefore protected if a business can use it to identify a customer. This should facilitate day-to-day data processing in craft businesses.  

The Data Union Strategy also clarifies that, in the case of artificial intelligence (AI), legitimate interest can be used as the legal basis for the training, development and evaluation of AI models in the future. This will also simplify the use of low-risk AI applications in the skilled crafts sector."
